Emailed the seller so we shall see what happens!!Basically told him he's listing and trying to sell an item he doesn't actually own etc etc and told him to delete the listing.Failing that ill email ebay and see what if anything they do

Its no bigdeal to me really nic!!but who knows what the buyer will get thinking there getting whats in the pic when its impossible for them to recieve that one in the pic.And if it goes for as much as mine did then thats 1 expensive con and maybe 1 very unlucky buyer

It's cheeky, happens to me a fair bit, but as long as it's a one off, not a regular or fake seller then it's not really worth doing anything about it....
Hopefully buyers would see your tag in the image and realise they are not the sellers original pics.
