eBay Case - Squeaky - 06-06-10

Hi All,

I bought a pair of LQ's from a private seller on eBay in April. I paid through PayPal. I have never received the shoes though. I contacted the seller several times and he says he did ship them. I opened a case on eBay anyway.

The shipment was insured and the seller said he would get my money back from Royal Mail. They guy is in no hurry and in about 3 days my case will be automatically ended.

I can escalate the case but this is what eBay says.

Quote:Only escalate if you have finished communicating with the seller.
You are authorising eBay Customer Support to make the final decision on this case. You cannot act on the case once it has been escalated.

What should I do???? What if eBay's decision is not positive for me???

I would escalate it too. I had the same issue over a bmx frameset, about a year ago. Escalated it and ebay found in my favour and I got my money back. It is up to the seller to prove to ebay/paypal that he sent it and pursue a refund from royal mail. good luck.

I just escalated guys. Thanks for convincing me. I have never had to do this before so wasn't really sure what to do.

I will let you guys know what the outcome is.

open one with paypal too
open one now
that way he will have the money taken from his account and it will be in limbo so neither party has access to it.

Do it through paypal...this is what happened with my JMJ's...If the guy has no tracking number to prove he sent them, paypal will pretty much automatically give you your money back. Even if he has proof of insurance, it doesn't matter, you have to provide tracking. Also, if you used your credit card to fund the paypal purchase, you can call your credit card company and do a chargeback. Do it through paypal asap, just open a claim saying you never got the shit, they will make him provide proof of tracking, once he cannot do that, they'll charge it to his account and refund you. Let him deal with getting paid from royal mail (which he probably never will).

Your other option is to use your network of connects and send someone to 'talk' to him...after all, you have the addy Sometimes I enjoy the old school way of finding resolution...or was that restitution?

Fuck, I can't open a PayPal-case anymore. The 45 days have passed. My Credit Card-company uses 30 days

Blimey.. I never wait that long to file a claim. As soon as I can, I do! You can always cancel it if your item arrives.
