I'd guess that the seller is acting against eBay rules, unless he's selling a chance to own the shoes? (even that is probably against their rules)
If not, then the winner of the earlier ending auction should win the shoes regardless, but unfortunately eBay cant enforce people to actually send item they have sold - as I'm sure a lot of people on here have experienced.
Conclusion - it's naughty but he'll probably get away with it
